Terms of Service
These Terms of Service ("Terms") govern your use of the Zoride rider app, driver app, and related services (together, the "Services"), operated by Zoride ("we", "us", "our"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old and capable of forming a legally binding contract to use the Services. Drivers must additionally hold a valid driving license, vehicle registration, and any permits required by applicable law, and must complete our verification process before accepting trips.
2. The Services
Zoride operates a technology platform that connects riders seeking transportation with independent drivers willing to provide it. Zoride is not a transportation carrier; drivers are independent and responsible for their own vehicles, licensing, and compliance with local transport regulations.
3. Accounts
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- You must provide accurate, current information when creating or updating your account.
- We may suspend or terminate accounts that violate these Terms, provide false information, or pose a safety risk to other users.
4. Booking, fares & payments
- Estimated fares are calculated based on distance, time, and applicable rates at the time of booking, and may be subject to surge pricing during periods of high demand.
- Final fare may vary from the estimate based on actual route taken, waiting time, tolls, or other applicable charges.
- Payments are processed through our payment partner, Razorpay. By making a payment, you agree to Razorpay's applicable terms for payment processing.
- Fares, once charged, are generally non-refundable except as described in our cancellation policy or at our discretion in cases of service failure.
5. Cancellations
Riders and drivers may cancel a trip before it begins. Cancellations made after a grace period, or with unreasonable frequency, may incur a cancellation fee, as displayed in the app at the time of cancellation. We may adjust cancellation windows and fees to maintain platform reliability; current rates are always shown in-app before you confirm a cancellation.
6. Driver obligations
- Drivers must maintain valid licensing, insurance, and vehicle registration at all times while active on the platform.
- Drivers must operate vehicles safely and in compliance with all applicable traffic and transport laws.
- Drivers are independent contractors, not employees or agents of Zoride, and are solely responsible for their own taxes and legal compliance.
7. Rider conduct
Riders must treat drivers and their vehicles with respect, not request stops or routes that are unsafe or unlawful, and provide accurate pickup and drop-off information. Abusive behavior, fraud, or safety violations may result in account suspension.
8. Location & communication
To provide the Services, we collect and share certain location and contact information between riders and drivers for the duration of a trip, as described in our Privacy Policy. By using the Services, you consent to this processing.
9. Service availability
We aim to keep the Services available and reliable, but we do not guarantee uninterrupted access. Driver availability, weather, traffic, and technical issues may affect service quality. We are not liable for delays or failures caused by factors outside our reasonable control.
10. Limitation of liability
To the maximum extent permitted by law, Zoride is not liable for indirect, incidental, or consequential damages arising from your use of the Services. Because drivers are independent contractors, Zoride is not liable for their individual acts or omissions during a trip, except as required by applicable law.
11. Termination
You may stop using the Services and close your account at any time. We may suspend or terminate your access if you violate these Terms, engage in fraudulent or unsafe behavior, or as required by law. See our Privacy Policy for how to request deletion of your account and data.
12. Changes to these Terms
We may update these Terms from time to time. We will revise the "Last updated" date above and, for material changes, provide notice in-app before the changes take effect. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in India.
